Duties and Responsibilities
The Kyrgyz Republic has undertaken key international obligations to ensure non-discrimination and human rights protections for all citizens, ratifying CEDAW, the Convention on the Rights of Persons with Disabilities (CRPD), and committing to the Sustainable Development Goals (SDGs). Despite constitutional guarantees and specialized legislation on state guarantees of equal rights, systemic protection gaps remain. In 2025, the Ombudsperson’s Office (Акыйкатчы), in collaboration with civil society organizations and gender experts, conducted the “Analytical review of the legislation of the Kyrgyz Republic on the protection of women and girls with disabilities from Gender-Based Violence”. The review identified critical institutional, procedural and physical barriers and recommended comprehensive legislative amendments to ensure accessible justice, procedural accommodations and specialized multi-sectoral support services. In response, a legislative initiative has been launched under the leadership of Member of Parliament T.A. Ashymbaeva, supported by the Council on the Rights of Women, Children and Gender Equality under the Speaker of the Jogorku Kenesh, the Ministry of Labour, Social Welfare and Migration (MLSVM) and international partners. The initiative focuses on enacting a comprehensive legislative package “On amending and supplementing legislative acts in the field of protection and safeguarding persons with disabilities from violence”. In accordance with the Law of the Kyrgyz Republic “On normative legal acts” and standard parliamentary requirements, draft laws entailing financial expenditures from the national budget must include a rigorous regulatory impact assessment and a statutory Financial and Economic Explanatory Note. International evidence shows that legislative reforms for violence prevention and disability inclusion fail or stall during governmental review if the financial liabilities across state agencies (such as social development, justice, health, internal affairs and the judiciary) are not precisely quantified and backed by realistic fiscal implementation modalities. The purpose of this consultancy is to conduct an independent, comprehensive costing analysis and fiscal impact assessment to elaborate the Financial and Economic Explanatory Note for the draft legislative package on the protection of women and girls with disabilities from violence. The expert will quantify direct and indirect budgetary implications, identify capital and operational expenditure baselines across responsible state bodies, model medium-term expenditure frameworks and draft the official Financial and Economic Explanatory Note required for public discussions, inter-ministerial agreement, and endorsement by the Cabinet of Ministers and the Jogorku Kenesh. Under the overall supervision of the OHCHR ROCA Gender Focal Point and in close coordination with the legal and gender experts of the working group established under MP T.A. Ashymbaeva and the Secretariat of the Council on the Rights of Women, Children and Gender Equality under the Speaker of the Jogorku Kenesg, the costing expert will perform the following tasks (as per approved work plan of the Parliament): 1. Methodological framework and fiscal scoping: establish a standard gender-responsive and disability-inclusive unit-costing methodology. Review the analytical baseline from the 2025 Ombudsperson's review, the draft law and international best practices for costing multi-sectoral gender-based violence services, reasonable accommodations, accessible infrastructure and specialized victim-support mechanisms. 2. Inter-agency financial data collection and working group engagement: participate in the inter-ministerial working group meetings (in coordination with MLSVM, Ministry of Finance, Ministry of Internal Affairs, Ministry of Health, Ministry of Justice, and the Supreme Court). Administer financial questionnaire tools and extract administrative and budget data on caseload volumes, current state expenditure baselines, personnel costs, training needs and equipment expenditures. 3. Unit costing and bottom-up expenditure modeling: develop a granular, dynamic Excel costing model applying activity-based and bottom-up unit costing. Model expenditures across core reform mandates, including: (a) accessibility retrofitting and reasonable/procedural accommodations in judicial and law enforcement facilities; (b) specialized medical, psychological, and accessible shelter services; (c) capacity-building curricula for judges, investigators, and social workers; (d) independent victimology research; and (e) upgrades to statistical recording systems disaggregated by gender and disability. 4. Drafting the official Financial and Economic Explanatory Note: prepare the formal statutory Financial and Economic Explanatory Note adhering strictly to Kyrgyz legislative drafting guidelines. Provide low, medium, and high-case budget scenarios across a 3-year Medium-Term Expenditure Framework (MTEF), identifying clear budget allocations between the republican budget, local budgets, Mandatory Health Insurance Fund (MHIF) and international donor contributions. 5. Substantive participation in consultations and parliamentary hearings: present the costing analysis, methodology and fiscal impact findings during stakeholder consultations and parliamentary hearings scheduled in November. Address technical questions raised by MPs, Ministry of Finance, state bodies and civil society. 6. Revision and government review support: support the legislative team in addressing formal feedback, comments and conclusions issued by the Ministry of Finance, parliamentary committee staff and government departments. Revise the Financial and Economic Explanatory Note and costing model accordingly to secure final financial clearance and committee adoption in the Jogorku Kenesh.
